Public Offer and Terms of Service

1. General Provisions

1.1. This document is an official offer (public offer) of Individual Entrepreneur Dokuchaev A.V. (hereinafter referred to as the Contractor) and contains all the essential conditions for providing services for accessing the "FluxDeep" software complex.

1.2. By accepting the terms outlined below and paying for the services, the legal entity or individual accepting this offer becomes the Customer. Acceptance of this offer constitutes the conclusion of a legally binding agreement on the terms set forth herein.

1.3. Acceptance (full and unconditional acceptance) of the terms of this Offer is considered to be the Customer's registration on the website https://fluxdeep.com and/or the performance of actions to pay for the Services.

2. Terms and Definitions

  • Service — the "FluxDeep" software complex, located on the Internet at https://fluxdeep.com, designed for the automatic generation, processing, and analysis of textual information using artificial intelligence technologies.
  • Personal Account — a secure area of the Service accessible to the Customer after registration, through which Services and balance are managed.
  • Balance — the Customer's virtual account in the Personal Account, displaying the amount of deposited funds that can be used to pay for content generation.
  • Generation — the process of creating a result (text, transcription, report) by the software tools of the Service at the Customer's request.

3. Subject of the Agreement

3.1. The Contractor undertakes to provide the Customer with access to the functionality of the Service (text generation, video transcription, document analysis) in accordance with the tariffs and prices published on the website, and the Customer undertakes to pay for these Services.

3.2. The Service is considered rendered by the Contractor at the moment the Generation result is provided to the Customer (displaying the text in the Personal Account or providing a file for download).

4. Payment Procedure and Balance Usage Rules

4.1. Access to the paid features of the Service is provided on a 100% prepayment basis.

4.2. Payment is made by the Customer by topping up the Balance in the Personal Account. Payments are processed through authorized payment aggregators (including bank cards and fast payment systems) and international payment gateways supporting digital currencies and alternative payment methods.

4.3. The Customer's payment obligation is considered fulfilled from the moment the funds are credited to the Contractor's settlement account or the transaction is confirmed by the payment system.

4.4. The funds on the Balance are not electronic money and can only be used to pay for services within the Service. No interest is accrued on the funds held on the Balance.

5. Refund Policy

5.1. Disclaimer for content quality: The Customer understands and agrees that the Service uses machine learning algorithms. The generation result may contain factual errors, inaccuracies, or may not meet the Customer's subjective expectations. The result's failure to meet the Customer's expectations is not a ground for recognizing the Service as of poor quality and requesting a refund.

5.2. Refunds for completed generations: Since the Service is consumed at the moment it is rendered (digital content), refunds for already completed generations are not provided.

5.3. Refund of the remaining Balance: All payments made to top up the Personal Account Balance are considered final and constitute a non-refundable advance payment for digital services and server resources. Funds credited to the Balance cannot be withdrawn or refunded to the Customer's payment method, regardless of the processing gateway used. Unused funds remain on the Customer's Balance for future use within the Service.

5.4. Technical failures: If funds were deducted from the Balance, but the Generation was not completed due to technical reasons (server failure), the funds are returned to the Customer's Balance automatically or upon request to technical support.

5.5. The processing time for refund requests is 5 (five) business days. Refunds are issued to the same payment method used for the original transaction within 5–30 days (depending on the Customer's bank).

6. Rights and Obligations of the Parties

6.1. The Customer undertakes:

  • Not to use the Service to create content that violates applicable laws (extremism, hate speech, pornography, etc.);
  • To independently verify the factual accuracy of the generated materials before their publication or use;
  • Not to transfer their credentials (login and password) to third parties.

6.2. The Contractor has the right:

  • To temporarily suspend the Service for technical maintenance;
  • To unilaterally change tariffs and generation costs (new prices do not apply to already paid and completed services);
  • To block the Customer's account without a refund in case of a violation of paragraph 6.1 of this Offer.

7. Limitation of Liability

7.1. The Service is provided on an "as is" basis. The Contractor does not guarantee that the Service will meet all the Customer's requirements, nor does it guarantee that the operation of the Service will be uninterrupted and error-free.

7.2. The Contractor is not liable for any direct or indirect damages (including lost profits) arising from the use or inability to use the Service, as well as from the use of the generated content.

7.3. The Contractor is not liable for interruptions, delays, or technical failures in the operation of third-party payment aggregators, processing gateways, or financial institutions.

8. Intellectual Property

8.1. Exclusive rights to the source code, design, and algorithms of the Service belong to the Contractor.

8.2. The rights to the content generated by the Customer using the Service are fully transferred to the Customer from the moment such content is created.

9. Final Provisions

9.1. The Agreement enters into force from the moment the Customer accepts the Offer and remains valid until the Contractor withdraws the Offer or the Customer's account is deleted.

9.2. All disputes and disagreements shall be resolved through negotiations. The claim procedure is mandatory. The response time to a claim is 30 days. If an agreement is not reached, disputes are subject to consideration in court at the Contractor's location.

9.3. The Contractor has the right to make changes to the text of this Offer unilaterally. The new version of the Offer comes into force from the moment it is published on the Website.
